EDMONTON, Alberta, January 19, 2010 (LifeSiteNews) - The parents of a critically-ill three-month-old boy have found themselves in a legal fight for his life, after being informed by the hospital that staff will be removing his ventilation because they have deemed that he cannot recover from brain damage he suffered during birth.

On October 24th, after a long, 40-hour labour, Isaac and Rebecka May and their son Isaiah James had to be airlifted to Edmonton's Stollery Children's Hospital because Isaiah's umbilical cord had been wrapped around his neck, resulting in severe oxygen deprivation.

While the hospital declared Isaiah “brain dead” shortly thereafter, Isaac and Rebecka have since joyfully watched him defy doctors' prognoses.  In a court affidavit, Rebecka explained that doctors had predicted Isaiah would only live a few days, that he would not grow, move, or urinate independently.  However, she says he has grown to almost eleven pounds, urinates on his own, dilates his pupils, and opens his eyes on a daily basis.

"Isaiah has moved his hands, arms and feet with increasing frequency and has arched his back," she wrote.  "He has brought his knees to his abdomen and has lifted his ankles up off the bed without touch or stimulation.”

Considering his progress, the Mays were shocked last Wednesday when they received a letter from the hospital informing them that Isaiah was not improving and that the hospital intended to remove his ventilator by this Wednesday at 2:00 p.m.

"The diagnosis is unchanged,” wrote Neonatal Intensive Care Unit clinical director Dr. Ernest Z. Phillipos.  “There is no hope of recovery for Isaiah."

"This mechanical ventilation may keep him in his present condition for some time but will not provide any benefit to him whatsoever because his severe brain injuries are irreversible,” he said further.  "We must put the interests of your son foremost and it is in his best interests to discontinue mechanical ventilation support."

The young parents took the hospital and Alberta Health Services to court today, seeking a 90-day injunction against the order.  They are also demanding access to Isaiah's medical records, which have been withheld.  Justice Michelle Crighton decided that she would await judgment until January 27th.

The hospital's decision to cut off Isaiah's ventilator is the culmination of the Mays' three-month struggle to obtain appropriate care for their child, explained Dr. Paul Byrne, a neonatologist with nearly five decades of experience and a former president of the Catholic Medical Association.  In their desperation, the Mays sought out Dr. Byrne's aid, and he said he has been in regular contact with them about their son.

Shortly after the doctors at Stollery declared Isaiah “brain dead,” said Dr. Byrne, “the parents were told that the doctors weren't going to treat the baby anymore.”

“They treat the baby on a ventilator, but they don't do any blood tests, they don't do any blood counts, or anything that needs to be done,” he said.  For example, he said that the normal procedure for anyone needing to be intubated as long as Isaiah is to perform a tracheotomy, due to the risk of damage to the vocal chords.  The parents have requested the procedure, “but [the doctors] won't do it,” he said.

The hospital did agree to conduct a blood test after the parents pleaded, discovering that Isaiah was anemic.  They gave him blood transfusions, which helped.  But, said Dr. Byrne, “the mother tells me that no blood tests have been done since November 15th.”

“This mother and father were not willing to accept that their baby was dead when [the doctors] said that the baby was brain dead,” he observed.  “Of course brain death never was true death and never will be true death.  It was something that was just made up so they could get [organs] for transplantation.”

Dr. Byrne said further that since starting his neonatal intensive care unit in 1963, and working in the field since then, “I've never found a situation where the baby needed to be taken off the ventilator.  I've never done that.”  He described one instance where a baby's brain waves completely flattened out, but he persevered, and the boy eventually achieved straight As in school, ran track, and is now married with three children.

“This is a horrible situation,” said Mary Ellen Douglas of Campaign Life Coalition.  “The parents have to beg and plead for help for their child, and when such minimal amount of help was given, the baby responded well to it, and yet the hospital has decided this baby is to die, and they're doing absolutely nothing to help the child.”

“This is a terrible precedent that they're setting for all babies that are born with difficulties,” she said, “and the courts should be aware of this, and stop the hospital from carrying out this action.”

Alex Schadenberg, executive director of the Euthanasia Prevention Coalition, has spoken with Rebecka several times, and explains that this situation appears to be an example of “futile care theory.”

“Even though the life-sustaining treatment is beneficial for Isaiah and may in fact lead to his survival,” he wrote on his blog, according to this theory, “he is not deserving of the treatment because even if he does survive, his life is considered futile.”

“The goal for the family is to bring Isaiah home and care for him themselves,” he said.  “The hospital is overstepping its role by unilaterally deciding when to remove life-sustaining treatment from a child that is improving.”

“This baby needs more time,” he continued.  “The family wants to care for their baby and I believe the hospital should be doing their best to allow that to happen.”

LifeSiteNews did not hear back from Alberta Premier Ed Stelmach's office by press time.

Stollery Children's Hospital has issued a statement expressing their sympathy for the Mays, and stating that “It is appropriate to turn now to the courts for direction.”  They have refused to answer questions.

Lifesite News is one of the great pro-life news sites that allows complete reprinting of their articles as long as they are properly attributed.

I have been following this on other news sites, where one of the latest updates continues:

That was the day chosen by Canada's publicly funded, government health service as the deadline for Isaiah to recover from his traumatic birth or be taken off life-support.

"There is no hope of recovery for Isaiah," reads a letter from Alberta Health Services delivered to Isaiah's parents and dated one week before the health care system intended to pull the plug on the baby it has determined irreparably brain damaged.

"Your treating physicians regretfully have come to the conclusion that withdrawal of active treatment is medically reasonable, ethically responsible and appropriate," the letter states. "We must put the interests of your son foremost, and it is in his best interests to discontinue mechanical ventilation support."

Parents Isaac and Rebecka May, however, immediately appealed to the courts for more time, encouraged by signs that their boy was growing and moving, pointing to instance after instance where Isaiah had already proven the doctors wrong.

"He is doing everything they said that he would not do. Every day he does something new. So that helps us to fight," the baby's 23-year-old mother told CBC News. "His eyes dilate. He opens his eyes. He moves his limbs. He's growing. He's gaining weight. He's living. They told us he would never do any of that."

We need to pray about this, and I hope everyone thinks hard about government involvement in health care and child care. This couple can't even transfer their child to another hospital to be cared for as they wish. How did this happen?

Lord grant us peace and strength amidst the storm, guide this family through, and help the little children!

I am confused as to what the Vatican has said about brain death (whether the technology of today can even decipher it). Huh? Embarrassed

There's a good if scary sermon on 'brain death'  over here.
Basically what is called 'brain death' nowadays is of course, not actual death according to Catholic teaching. Therefor you can't inflict fatal injuries, deny ordinary means of care, etc. to a person who doctors call 'brain dead' or 'vegetables'. All these terms are not Catholic, and are considered euphemisms that in fact, are used to cover up that a person is actually alive.

A person is alive until the soul has left the body. Brain activity is not a measurement of life or death -- the mind is more than the activity of the brain, it is part of the soul too.

So therein lies the conflict: doctors want the organs for transplantation -before- a person dies, because the organs last longer, are healthier, etc. They have a vested interest in taking organs out of people who are alive but non-functional, in other words, better off dead, to give to people whose lives have 'more value'.

Of course like all areas of morality today there are people 'Catholics' on medical boards and in positions who feel it is their job to blur the lines, change things and make things easier for the doctors and favor their views if possible. Just like with JFK, who said his faith wouldn't affect his governing, or 'Catholic' hospitals that allow abortions and contraception.. there're a lot of people trying to change where that line of morality is.

We have to be aware of these things so we can give people the right message about the sanctity of life!  Little Angel

Baby Isaiah Granted Another Three Weeks for Medical Assessment

EDMONTON, Alberta, January 27, 2010 (LifeSiteNews.com) – Baby Isaiah May has been granted at least another three weeks of life, after an Alberta provincial court ruled that he should remain on life support until February 19th while lawyers have him assessed by medical experts.

Isaiah was born to Isaac and Rebecka May on October 24th.  During a long and arduous labour, Isaiah suffered severe oxygen deprivation because his umbilical was wrapped around his neck.  The Mays were flown into Stollery Children's Hospital in Edmonton, where he has been ever since.

The Mays have cared for Isaiah at the hospital, and say they have watched him improve steadily; so they were shocked on January 13th when they received a letter from the hospital saying that he had not improved, and that “there is no hope of recovery for Isaiah.”  The letter stated that his ventilator would be removed on January 20th.

The Mays took the hospital and Alberta Health Services to court last Wednesday asking for a 90-day injunction against the hospital's order.

The case has drawn international attention, with a flood of support for the May family.  Their Facebook group, “Prayers for Baby Isaiah James,” has grown to almost 25,000 members, up from less than 5,000 one week ago.

EDMONTON, Alberta, January 27, 2010 (LifeSiteNews.com) – A provincial court in Alberta ordered Friday that baby Isaiah May remain on life support until March 11.  The order gives Isaiah's parents, who have been fighting to keep their brain-damaged baby alive, nearly three more weeks to assemble outside medical experts to assess his chances for further recovery.

Judge Michelle Crighton gave the order, which requires Stollery Children's Hospital in Edmonton to keep the nearly five-month old baby on his ventilator until at least that date.

Rebecka and Isaac May have been locked in a court battle since January with Alberta Health Services, which says it does not believe baby Isaiah will make further improvements, and therefore not worth the effort of keeping him alive.

Isaiah was born to Isaac and Rebecka May on October 24, 2009. During a long and arduous labor, Isaiah suffered severe oxygen deprivation because his umbilical was wrapped around his neck.  The Mays were flown into Stollery Children's Hospital in Edmonton, where he has remained ever since.

The Mays' lawyer told Judge Crighton that Dr. Richard Taylor, a neonatologist from Victoria General Hospital, will be assessing Isaiah’s condition Friday.

According to CTV News, two other doctors are expected to give assessments of baby Isaiah’s chances for recovery, including one doctor from the prestigious Johns Hopkins Hospital in Maryland, who specializes in unusual medical cases.

"He's doing very well, there hasn't been very many improvements over the past few weeks but he's still growing,” said Isaac Mays, according to CTV. “He's over 12 pounds and he just looks like a perfect little boy.”

The parents were shocked on January 13 when they received a letter from the hospital asserting that their baby had not improved since birth, adding “there is no hope of recovery for Isaiah.”  The hospital informed them that his ventilator would be removed on January 20.

The Mays thereafter took the hospital and Alberta Health Services to court.

Media have repeatedly cited the group’s growth as a sign of the large public support for the parents as they struggle to give their son a chance to live.

 Sorry to be very vague with details but - recently I read somewhere in the news of a grown man that woke up from a coma . He was not at all expected to do so.  The story made me think medical powers that be need ALOT more information about how the human brain can recover . So sad that hospitals too quickly make decisions & probably because of effort & money .

So sad that hospitals too quickly make decisions & probably because of effort & money .

But that he woke from the coma is wonderful! rejoice Doctor's and hospitals will learn - look at Lister, penicillin and epidurals (cheers).

He was not at all expected to do so.  The story made me think medical powers that be need ALOT more information about how the human brain can recover . So sad that hospitals too quickly make decisions & probably because of effort & money .

Yes they have new tests now that if we had just a year or so ago, we could have realized a great deal more about this all!
